When must my landlord return my deposit?
In California, a landlord has 21 days after you move out to return your security deposit or send an itemized statement of deductions with the rest of the money (Civil Code § 1950.5). Enter the day you moved out to see the deadline and how many days are left.
Good to know
The 21 days start when you have moved out and given up possession, usually when you return the keys. Give your landlord a forwarding address in writing so the deposit or statement can reach you.
Deductions are allowed only for unpaid rent, cleaning back to the condition at move-in, damage beyond ordinary wear and tear and, if the lease allows it, restoring or replacing personal property. Normal aging of the unit is not a valid deduction.
If the landlord keeps the deposit in bad faith, a court can award damages of up to twice the deposit in addition to the amount wrongly withheld. Many tenants bring these claims in small claims court.
