Repairs keep getting put off?
Habitability is the landlord's duty.

California landlords must keep rental homes fit to live in: working plumbing, heat, weatherproofing, safe wiring and no infestations. An independent California attorney helps you document the problem and choose a next step that does not put your tenancy at risk.

A free, no-obligation first call. Fee terms explained in writing before any work starts.

The essentials

What matters for repairs and habitability?

01

The warranty of habitability

Civil Code § 1941 and § 1941.1 require the landlord to keep the unit in a condition fit to live in, with basic standards such as heat, water, plumbing and electrical systems.

02

Ask in writing

Describe the problem, the date and a reasonable deadline. Keep copies and photos. Written notice is the basis for every later step.

03

Repair and deduct has limits

Under Civil Code § 1942 a tenant may in some cases pay for a repair and deduct it from rent, but only up to one month's rent and not more than twice in 12 months.

04

Protection against retaliation

A landlord may not raise the rent, reduce services or start an eviction to punish you for asking for repairs or contacting a code inspector (Civil Code § 1942.5).

Easy to start

No big leap.
Just a first step.

You tell us what is going on. We find the right attorney for it.

  1. 01

A few words about your situation.

Choose your topic and leave your contact details. You don’t need a complete file to get started.

  2. 02

    A free first call.

Our intake team gets in touch, clarifies what you need and connects you with an independent attorney licensed in California.

  3. 03

Clear fee terms before any work.

The attorney reviews your case and explains the scope and the fee arrangement in writing. You decide whether to go ahead.

For later, not for now

What you can have
ready for the call.

You don’t need to upload anything in the form. These documents can help later:

  • Photos and videos of the problem with dates
  • Your written repair requests and any replies
  • Inspection reports from the city or county, if any

Withholding rent without advice can lead to an eviction case. Talk to an attorney first. An enquiry does not stop any deadline.

You may still be wondering …

Before we
talk.

Can I stop paying rent until the repairs are done?

Withholding rent is risky. If a court later finds the problem was not serious enough, you may be evicted for nonpayment. An attorney can tell you whether it is an option in your situation and how to protect yourself.

Who can inspect my unit?

Many cities and counties have a code enforcement or housing inspection office. An inspection report is strong evidence of a habitability problem.

What does the first call cost?

The first call is free and without obligation. If you want an attorney to take on your matter, the attorney explains the scope and fee arrangement in writing before any work starts.

What happens after I send my request?

Our intake team reviews your request and gets in touch to clarify it and arrange the call. Sending the form does not create an attorney-client relationship and does not book an appointment.

Two people look through a document together.

The first step is free

So you can get back to simply living at home.

Time for your situation.
Clear, personal and without obligation.
