Security deposit · California
After you move out, your landlord has 21 days to return the deposit or send an itemized statement of deductions. An independent California attorney checks whether the deductions are allowed and how to ask for the rest.
A free, no-obligation first call. Fee terms explained in writing before any work starts.
The essentials
Within 21 days the landlord must return the deposit or send an itemized statement explaining each deduction (Civil Code § 1950.5).
If the deductions add up to more than $125, the landlord must generally include copies of invoices or receipts.
Deductions are allowed for unpaid rent, cleaning back to move-in condition and damage beyond ordinary wear and tear, not for normal aging of the unit.
For most leases signed since July 1, 2024, the deposit may not exceed one month's rent. Some small landlords may charge up to two months.

For later, not for now
You don’t need to upload anything in the form. These documents can help later:
Give your landlord a forwarding address in writing. An enquiry does not stop any deadline.
You may still be wondering …
A court can award the amount wrongly withheld and, for bad-faith retention, additional damages of up to twice the deposit. Many tenants bring these claims in small claims court.
Yes. After you give notice, the landlord must tell you in writing that you can request an initial inspection, so you have a chance to fix issues before you leave.
The first call is free and without obligation. If you want an attorney to take on your matter, the attorney explains the scope and fee arrangement in writing before any work starts.
Our intake team reviews your request and gets in touch to clarify it and arrange the call. Sending the form does not create an attorney-client relationship and does not book an appointment.
