What is local in Oakland

The Rent Adjustment Program, the court and free help

01

Rent Adjustment Program (RAP)

RAP administers Oakland's rent ordinance. Tenants can file petitions to contest certain rent increases or ask for a decrease for reduced services or code violations, and housing counselors answer questions. RAP publishes the allowable yearly increase.

Just Cause for Eviction Ordinance

Adopted by Oakland voters and amended several times since, the ordinance (Oakland Municipal Code § 8.22.300 and following) requires one of the listed just causes to end a covered tenancy. The sale of the property or the end of a lease is not a just cause by itself, and landlords must file a copy of eviction notices with RAP.

Alameda County Superior Court Self-Help Center

You may still be wondering …

Before we
talk.

Does RAP decide whether I can be evicted?

No. Evictions are decided by the Superior Court. RAP handles rent petitions, counseling and the filing of eviction notices.

Can my landlord end my tenancy because the lease expired?

In Oakland, the expiration of a lease is generally not a just cause by itself for covered units. An attorney can check whether your unit is covered.

What does the first call cost?

The first call is free and without obligation. If you want an attorney to take on your matter, the attorney explains the scope and fee arrangement in writing before any work starts.

What happens after I send my request?

Our intake team reviews your request and gets in touch to clarify it and arrange the call. Sending the form does not create an attorney-client relationship and does not book an appointment.
